Amending the Environmental Plan

We can facilitate most developments with an environmental permit, but some developments can only be realized with a change to the environmental plan. For example, the environmental plan must be changed if the municipality wants to allow a house to be built on a site that is not currently zoned for that purpose, for example because it is a plot of land zoned for agricultural use. 

You can use the preliminary consultation to explore and discuss new ideas. During the preliminary consultation, you will receive information about the possibilities, costs, and average processing time for your application.

How is a change to the environmental plan implemented?

  1. Currently working on: 1 . In advance

    The municipality announces that the environmental plan will be amended. The publication – Notice of intention to amend the environmental plan – also announces how the community will be involved. This is called participation. The initiator or the municipality indicates how they will organize the participation and how stakeholders can participate.

  2. Still to be done: 2 . Drafting a draft amendment to the environmental plan

    The draft amendment decision indicates what has been done with the responses from the participation process.

  3. Currently in progress: 3 . Draft amendment to the environmental plan

    The municipality will make the draft amendment to the environmental plan available for inspection. Anyone can submit a response (opinion).

  4. Still to be done: 4 . Adopt amendment decision on environmental plan

    The municipal council adopts the amendment to the environmental plan. The participation report is included in this.
    An appeal against an adopted amendment to the environmental plan can be lodged with the Council of State.

How long does it take to amend the environmental plan?

A period of 26 weeks applies to the amendment of the environmental plan. This period applies to the completion of the procedure for amending the environmental plan. The procedure starts at step 3 in the above step-by-step plan.

The 26-week period does not apply to the transition from the temporary environmental plan to a new environmental plan. We have until January 1, 2032, to complete this transition.

How can you submit a request to change the environmental plan?

  • Sweeping plans

    Under the omgevingswet , we now omgevingswet only one environmental plan. All individual plans that are made possible by an amendment to the environmental plan must therefore be incorporated into this single document. It is therefore not possible to follow an amendment procedure for every development. The basic principle is therefore that developments should be bundled together as much as possible.

    We do this by means of sweeping rounds. 
    Twice a year, we review whether there are any plans that qualify for a sweeping round.

    A plan can only be included in the sweeping round under the following Requirements:

    • You have submitted a request to amend the environmental plan; The request is admissible and complete; The new section of the environmental plan already contains rules that can be applied;
    • A decision was made less than a year ago (principle cooperation).

  • H21 plans

    There are plans that cannot be implemented with a sweeping plan or with an environmental permit for activities outside the environmental plan. We refer to these as'Chapter 21 plans'.
    Our environmental plan contains a separate chapter for this: Chapter 21. 
    To be eligible for a change in Chapter 21, coordination and cooperation with the municipality is always required.
