The municipality of Leudal respects your privacy. You are entitled to expect the municipality of Leudal to handle your personal data with care and confidentiality. This is laid down, among other things, in the General Data Protection Regulation (AVG). In this privacy statement, we give you insight into the principles that the municipality of Leudal applies when processing your personal data.

Processing personal data

The Municipality of Leudal processes personal data because you use our services and/or because you provide these data to us, for example through DigiD. Personal data is information that can be traced back to a natural person. Examples of personal data are:

  • First and last name;
  • Address information;
  • Date of birth;
  • Contact information such as e-mail and phone number.

The municipality of Leudal processes personal data for telephone contact, informing about changes in services or when we have a legal basis for doing so. These legal bases can be: legal obligation, agreement, vital interest, consent and public law duty.

We obtain personal data from you when, for example, you register with the municipality, apply for a passport or require a permit. When you visit the municipality's website, you also provide us with personal data in some cases. For example, in the form of an IP address or via a cookie that registers certain preferences.

Special personal data

In addition to ordinary personal data, we may also process special personal data about you when you use our services and/or you provide these data to us. The municipality will only process this data if it is permitted from a specific legal exception and based on one of the aforementioned legal bases.

The municipality is authorized to process (special) personal data within the framework of the WMO. This includes data about the health of an applicant. Consent for this is regulated in Article 4, section 15 of the GDPR. The WMO department may only process personal data that is necessary for the performance of its tasks. This applies, for example, if a citizen is provided with a customized service.

Retention of personal data

The Municipality of Leudal does not retain your personal data longer than (legally) necessary to realize the purposes for which your data are collected. In a number of cases, your data will be kept longer under the Archive Act.

Sharing personal data with third parties

In principle, the Municipality of Leudal does not provide your data to third parties. We only provide data to third parties if this is necessary for the execution of the agreement with you or to comply with a legal obligation. We conclude a processing agreement with organizations that process your data on our behalf to ensure the same level of security and confidentiality of your data. The Municipality of Leudal remains responsible for this processing.

Security

The municipality of Leudal takes appropriate measures to prevent abuse, loss, unauthorized access, unwanted disclosure and other undesired actions with personal data. These measures are laid down in the Baseline Information Security Government (BIO) and included in our information security policy. Despite our efforts, incidents can occur. Think of an incorrectly addressed e-mail or letter, a website containing too much information, or a file that gets lost. It is important that the municipality is notified as soon as possible. We can then take steps to prevent worse and, if necessary, want to inform those involved of the incident. If you suspect that such an incident has occurred, please report it immediately to the municipality using the security incident form.

Supervision of personal data processing

Within the municipality, usually the College of Mayor and Aldermen is responsible for the lawful processing of personal data. Sometimes this is also the mayor or city council. Each department head carries Health proper handling of personal data within his or her department. All our employees are obliged to maintain confidentiality. This means that we handle the data you entrust to us with care. Only authorized personnel may process your data. An officer has been appointed within the municipality who is responsible for ensuring proper compliance with privacy laws. This is the Data Protection Officer (FG). Part of the FG's duties includes answering privacy-related questions.

Your rights

You have the right to access, correct or delete your personal data. In any case, the municipality will respond to this request within four weeks. It is important that you can identify yourself and prove that the data you want to see, correct or delete actually belongs to you. It is not permitted to view data belonging to other persons. You can request access, correction or deletion via form right of data subject.

The Municipality of Leudal uses cookies on its website. A cookie is a text file that is stored on your computer, tablet or smart Phone the first time you visit this website. These cookies are necessary for the technical operation of the website and your ease of use. They ensure that the website works properly and remember, for example, your preferences.

If you wish, you can choose to opt out of cookies through your Internet browser. In addition, you can also delete any information previously stored through your browser settings.

As a municipality, we are interested in data that provides insight into behavior of visitors to our website. This data is measured using an analytics program. For example, we measure which pages are visited the most, at what time most visitors come, how long visitors stay on the site, etc. The sole purpose of this is to improve the website.

Children

The Municipality of Leudal does not intend to collect data on website visitors who are under the age of 16, unless they have parental or guardian consent. However, our website cannot verify whether a visitor is older than 16. We therefore recommend that parents be involved in their children's online activities to prevent their personal data from being collected without your consent.

Social Media 

The municipality of Leudal uses Facebook, among others, for its social media communications. Facebook is a frequently used medium within the municipal world to communicate with its residents. However, Facebook cannot meet the privacy requirements of the European GDPR by canceling the Privacy Shield agreement. Despite the fact that, given the purpose for which this page is used, it is very small, we would like to point this out to you. Of course, we handle your personal data carefully when posting on social media. In addition, the use (subscribe and unsubscribe on Facebook) is without obligation and thus concerns your own choice.

The Municipality of Leudal processes your data in case of offenses for criminal enforcement based on Article 8 of the Police Data Act (Wpg) in the following areas; 

  • Domain I, Public Space;
  • Domain II, Environment, Welfare and Infrastructure; and 
  • Domain III, Education. 

These data are kept for 10 years and can be shared with the following parties: the Municipal Executive, supervisors, the Police, CJIB, the Public Prosecutor's Office, the Mayor, Bureau HALT, RIEC, Safety House and the Child Protection Council (the latter only in compulsory education cases) as well as with boas working within other investigative agencies.

You have the right to access and, in certain cases, rectify, supplement or erase your data. You can request this by using the "Data Subject Right" form, which you can find above under the heading "Your Rights.
