Unfair competition in the hospitality industry.
Associations and institutions that have a canteen must comply with the rules of paracommercial as included in the General Ordinance of the Municipality of Leudal.
Associations/foundations were informed of this by letter at the time. It is time again to bring the main principles to your attention.
Main goal
An association/foundation is established with a main purpose listed in its bylaws. This main purpose often relates to the practice of a sport or other activity. However, not the provision of alcoholic beverages. Beverage dispensing is done "on the side". Therefore, restrictions are placed on the provision of alcoholic beverages in canteens of associations/foundations. This is to prevent unfair competition with the regular catering industry.
Pour times
The serving times of alcoholic beverages are linked to the activities of the association/foundation. That is, alcoholic beverages may be served one hour before the activity and two hours after the activity ends.
No alcohol dispensing
It is prohibited to hold meetings of a personal nature in the establishment, at which alcoholic beverages are provided. This includes, in any case, weddings and parties.
Exceptions
There are activities that may be organized where alcohol may be provided. These can be found in article 2.5.4.2 paragraph 3 General Regulation. To be found via overheid.nl, local laws and regulations.
If a planned activity does not appear on the list, the mayor must decide on it.
A written request must be submitted for this purpose.
Prohibition to rent out
It is further prohibited to rent out the paracommercial establishment (e.g. canteen) and inventory to third parties (individuals) for the purpose of activities involving the serving of alcohol.
