What is the environmental plan?
In the environmental plan, the municipality regulates the physical living environment, such as buildings, roads, water, nature, soil, air, odor or, for example, noise. The environmental plan of the municipality of Leudal contains rules with which we distribute the limited space in a good way. This way we enable developments and protect our living environment.
For example, the environmental plan regulates whether you may build on a piece of land, how high, wide and deep a building may be and what it may be used for. This is important if you are applying for a permit to build. The environmental plan is legally binding. Everyone must abide by it, including the government.
The Omgevingswet will apply from January 1, 2024. From this date, every municipality will have one temporary environment plan for the entire territory. The temporary environment plan consists of the rules of all zoning plans within the municipality of Leudal, part of the rules of the General Ordinance and rules we have received from the State. These Rules and concepts from zoning plans and the other documents and their explanations may differ from one area to another. Therefore, each municipality must merge all these different documents and move the rules into one complete environmental plan for the entire area of the municipality. Bringing rules together into one coherent environmental plan will make them /unambiguous and easier to find.
We have eight years to do this, until January 1, 2032. We call this the transition period. During this period, we will move step by step to a single environmental plan, which contains the rules for the physical environment.
Note: Not all rules that deal with the physical living environment are in the environmental plan. There are also rules about the physical living environment that are in, for example, the provincial environmental ordinance, the water board ordinance or a regulation of the State. There are also municipal ordinances that contain rules that may concern the physical living environment, such as the General Ordinance.
