In addition to national environmental regulations, the municipality of Leudal has adopted its own environmental regulations.

Policies for application of spray zones.

The municipality of Leudal has developed policy for spray-free zones to better deal with the challenges surrounding the use of plant protection products near sensitive destinations. Due to the lack of national regulations on distances between sensitive functions or destinations and agricultural land, the municipality is forced to develop this policy itself. With this policy, Leudal wishes to achieve a balanced solution between national regulations and the need that both protects the health of residents and does justice to the agricultural sector.

With this policy document we strive for a noise quality such that in the immediate living environment only negligible risks to health are incurred and no serious nuisance is experienced. By developing the noise policy on an area-specific basis, the possibility arises to make a distinction between quiet and noisy areas.

Soil management memorandum and associated soil quality maps.

With the Omgevingswet , a large part of the Soil Management Memorandum of Limburg North has lapsed and is instead subject to directly effective State regulations from the Omgevingswet.
An important part of the Memorandum is the use of the soil quality map as a legal means of proof to visualize the quality of the soil in unencumbered areas. This soil quality map will remain valid after the Omgevingswet enters into force.

Nota Bodembeheer Limburg Noord

The Soil Management Memorandum Limburg North 2020-2029 (hereafter the Memorandum) is a joint memorandum of the 15 North and Central Limburg municipalities. The Memorandum describes how the region deals with soil contamination and what possibilities there are for applying and reusing soil. The Memorandum provides rules and guidelines for everyone who must take the quality of the soil into account when preparing projects or carrying out soil works.

The Nota is inextricably linked to the soil quality map (BKK), which indicates the soil quality within a certain area. A BKK is drawn up to enable soil movement in an efficient, cost-effective and responsible manner.

At the time the Omgevingswet (Ow) comes into force, parts of the Memorandum will lapse and directly effective Kingdom rules will apply instead. Part of the texts from the Note will expire and part will be retained as part of the transitional law. Clean Air Agreement (SLA).

On July 7, 2020, the municipality of Leudal decided to participate in the Clean Air Agreement (SLA). The ambition level has been set by the State at a joint 50% health gain compared to 2016. To achieve this objective, it is mandatory to adopt an annual implementation plan with fixed measures per theme (such as Agriculture, Industry Mobility, Mobile Tools and Wood Burning).

Industrial odor policy for bio-based activities at the Zevenellen business park

This policy has been drawn up to set guidelines for the development of the Zevenellen industrial estate. The policy answers the question of to what extent odors from biobased industry are acceptable based on legislation and regulations and with a view to maintaining an acceptable residential and living environment, particularly in the center of Buggenum.

Policy rule on withdrawal of environmental permits for environmentally harmful activities at livestock farms municipality of Leudal

With these policy rules, the environmental permit for an environmentally harmful activity at livestock farms is revoked if the permit has not been used for a certain period of time. A distinction is made here between:

  • In case of urgent/urgent interests, the period of 1 year is applied. This is the case if:
    • if the activity for which the mba environmental permit is granted is located in a residential core, core edge zone and/or groundwater protection area, as designated in the Environment Plan applicable to that activity;
    • if the activity for which the environmental permit mba has been granted is located within 1,000 meters of a Natura 2000 area or 250 meters of an other area in the Nature Network Netherlands;
    • if the relevant contour maximum foreground odor load (Article 3.5.2 of the General Ordinance Municipality of Leudal) of the activity for which the environmental permit mba has been granted exceeds the corresponding area designation residential core, core edge zone or care initiative Hornerheide (Appendix 3 of the General Ordinance Municipality of Leudal);
    • if the activity for which the mba environmental permit is granted conflicts with the Environment Plan that applies to that activity.
  • In case of no urgency/heaviness, the 3-year term is applied.

The policy rules apply to livestock farms in the municipality of Leudal that require an environmental permit. Of all livestock farms, on December 31, 2023, approximately 25% required an environmental permit. The other 75% were subject to general rules, whereby a notification cannot be withdrawn and for which the policy rules therefore do not apply.

Part of the licensed activities for environmentally harmful activities (mba) on livestock farms are not realized within a certain period of time or are not realized at all. This creates so-called latent space or dormant permits: space that is permitted but not used. Maintaining (and possibly reactivating) mba's for livestock farms licensed in the past can be detrimental to the environment, due to emissions of ammonia and particulate matter, odor and soil contamination and discharges. Moreover, for various other reasons, legal, policy and practical, it is not desirable to leave environmental permits in place without their implementation within a certain period of time.
