Fire-safe use of structures
What is it?
For buildings where many people gather, a use notification fire-safe use may be required. An environmental permit for the fire-safe use component may be necessary for overnight stays, for example. How does it work?
Whether you need a use notification or an environmental permit for the fire-safe use component depends on the structure.
Fire-safe use of structures
Legislation stipulates that the use of certain structures must comply with the requirements of fire-safe use of structures. This distinguishes between:
- general use;
- use based on use notification;
- use based on environmental permit;
General use
All structures must comply with the general regulations for fire-safe use of structures. Even if no notification or permit requirement applies. These general regulations are included in the Building Code 2012.
Use based on use notification
The use notification is submitted to the competent authority if it concerns a structure in which more than 50 persons will be present at the same time, or if it concerns a residential function that is put into use for room-by-room rental or use in which the regulations of the Building Act 2012 are not met, but in which another solution has been applied that offers at least the same degree of fire safety as required in the Building Act 2012.
You must submit your notification through the Omgevingsloket. You must submit the notification at least four weeks before use of the structure.
Use based on an environmental permit
Such a permit shall be applied for if there is business or care night accommodation provided to more than 10 persons or day accommodation provided to more than 10 persons under 12 years of age, or more than 10 physically or mentally disabled persons.
Terms
The statutory decision period for an environmental permit for putting into use or using structures in relation to fire safety is 26 weeks. Within the said period, the municipality is expected to make a decision and communicate it to the applicant.
Revocation of permit
The municipality is authorized to revoke a granted environmental permit. However, the permit holder must first be heard about this.
Objection and appeal
All decisions regarding permits and exemptions can be appealed to the Administrative Law Division of the District Court. Filing an objection, appeal or appeal does not in itself have a suspensive effect. If you want to try to prevent the execution then you can file a suspension request with the Interim Injunction Judge of the District Court.
