How does it work?
You need the permit for work for which the zoning plan requires a permit. This permit allows municipalities to check the proposed work against planning regulations.
The municipality also checks whether the work requires a monument permit. This applies, for example, to protected city or village sights and archaeological areas of interest.
To qualify for a construction permit, you must meet at least the following Requirements:
- The work or activities do not conflict with the zoning plan or the requirements thereunder. Nor are they in conflict with a zoning plan that is in preparation;
- the work or activities require a permit under the Heritage Act or General Ordinance.
Terms
The statutory decision period for an environmental permit for a construction activity is in principle 8 weeks. Within said period, the municipality must make a decision and communicate it to the applicant.
Objection and appeal
Interested parties may object to or submit opinions against all decisions on the granting of permits, then appeal to the District Court and finally appeal to the Administrative Law Division of the Council of State. The lodging of objections, appeals or appeals does not in itself have a suspensive effect. If you wish to try to prevent implementation, you can request a preliminary injunction from the preliminary relief judge of the court.
