Alcohol License

What is it?

  • If you serve or sell alcohol, you need an alcohol law license from the municipality.
  • If you want to serve alcohol during an event, you must apply to the municipality for an exemption.

No permit required

You may sell beer, wine, port and sherry in the following establishments:

  • supermarket
  • food store
  • snack bar
  • caterer
  • tobacco store

You do not then need a license. You may not have alcohol tasting in your business.

How does it work?

An alcohol license allows you to sell and serve alcohol to persons 18 and older, for use on the premises.

You can get the permit if you meet the following Requirements:

  • Your staff members are 16 years of age or older;
  • your bartender under 18 may sell alcohol but not drink it;
  • all managers are at least 21 years old and have an SVH Declaration of Social Hygiene or Declaration of Professional Competence. You can look this up in the Register of Social Hygiene;
  • none of the executives has a criminal record, and
  • A manager must always be present in your business. This manager is also listed on your license.

Associations and foundations

Additional Requirements apply to associations and foundations that serve alcohol:

  • the hours alcohol is served and the age limit is posted in a highly visible place;
  • there are at least two managers within the association or foundation with an SVH Certificate of Social Hygiene;
  • if alcohol is served, at least one of these managers is present, and
  • house rules regarding alcohol consumption are in the board rules.

The Municipality of Leudal has regulated this in Articles 2:34a and 2:34b of the APV.

What does it cost?

The costs are:

  • An alcohol license application: €447.25;
  • An amendment to an alcohol license: € 223.55.
  • An amendment to the appendix to the alcohol law license (names of managers): €94.70.

An application for a dispensation as referred to in Section 35 Alcohol Act (temporary dispensation to tap) is not subject to any legal fees.

We distinguish 2 types of Alcohol licenses:

  • Alcohol license model A: for commercial enterprises, and
  • Alcohol license model B: for associations and foundations.

For both types, if you wish to apply for a permit, our preference is that you first make an appointment with our colleagues in the General Ordinance Department. We can then review your plans together and advise you directly regarding the steps you need to take. We will also discuss how you can submit the application and what documents are required to do so. DigiD

What to do.

You apply for the permit at the municipality. Do this in the municipality where your business, association or foundation is located.

What do I need?

  • certificate of social hygiene
  • valid ID of each person named on the permit
  • plan of the company, including terrace
  • Official board regulations (this applies only to associations and foundations)

The municipality may ask for additional documents, such as employment contracts of the executives.

Always notify new supervisor

If a new manager is added, you must notify the municipality. You do not need to apply for a new permit for this.

How long does it take?

In principle, you will be notified within 8 weeks.

Objecting

If you disagree with the municipality's decision, you can object within 6 weeks.

Bibob Act

If you, as a catering entrepreneur, apply for a liquor and catering license and/or an operating license, you must also do a test of the Bibob Act. Bibob means: Promotion of integrity assessments by public administration.

The test is used to screen companies and individuals. If the municipality suspects that the permit may be misused for criminal activities, the permit may be refused or revoked under the Bibob Act. More information about the Bibob Act can be found on the website of the Justice Service.
