Regulations use banging equipment

The use of popping equipment is subject to a number of regulations that help ensure its safe and responsible use.

Definitions

In these general rules, the following definitions shall apply:

  • Evening period: the period from 7 p.m. to 10 p.m;
  • outer area: the outer area comprises the entire territory of the municipality of Leudal with the exception of the built-up areas;
  • day period: the period from 6 a.m. to 7 p.m;
  • noise-sensitive objects: sensitive buildings and sensitive sites;
  • sound equipment: any object used to chase away game or fowl that produces sound;
  • popping device: special sound device that produces a bang for the purpose of scaring away game or poultry;
  • night period: the period from 10 p.m. to 6 a.m.

General rules noise equipment instead of permit requirement

Noise equipment may be used only if the following requirements are met:

  • The long-term average assessment level (Lar, LT) due to noise generated by noise equipment during the day, evening and night periods shall not exceed 45, 40 and 35 dB(A) at the facade of noise-sensitive objects, respectively;
  • The maximum noise level due to noise generated by sound equipment, including popping equipment, will not exceed 70 and 65 dB(A) at the facade of noise-sensitive objects during the day and evening periods, respectively;
  • Sound equipment, including popping equipment, may not be in operation between 10 p.m. and 6 a.m.

General rules popping equipment in lieu of permit requirement

Popping equipment may be used only if the following requirements are met:

  • the shortest distance between a popping device and the public road is at least 100 meters. This distance may be reduced to 50 meters if road users and walkers are warned with clearly visible and identifiable warning signs indicating that a popping device is in operation;
  • the barrel of a popping device must be turned away from noise-sensitive objects. If this is not possible because the plot is in the middle of several noise-sensitive objects, then a rotating barrel is allowed;
  • the bang frequency in the day period is a maximum of 10 bangs per hour, in the evening period the bang frequency is a maximum of 4 bangs per hour;
  • twice in the day period from 6 a.m. to 7 p.m. a maximum of 15 shots may be fired within a 15-minute period. No popping device may then be deployed for the remainder of the day period;
  • Notwithstanding the provisions of Article 1.2.4, the distance between a popping device and a noise-sensitive object shall be at least 250 meters;
  • Cumulation of noise from multiple popping devices in close proximity to each other must not result in unacceptable annoyance. A second popping device near an already installed device must therefore be placed at least 300 meters from the first device. If several popping devices are set up within 300 metres of a noise-sensitive object, the maximum is 8 bangs per hour during the daytime period and 4 bangs per hour during the evening period.
  • A minimum of three other scaring techniques, in addition to popping equipment, must be used.
